These Terms and Conditions ("Terms") govern your use of the Living Space Solutions website and your engagement with our residential services. By accessing this site or engaging our services, you accept these Terms in full.
Services are provided under individual written agreements that incorporate these Terms by reference. The service agreement supersedes any conflicting provisions herein. All work is performed in accordance with applicable International Residential Code (IRC), International Plumbing Code (IPC), National Electrical Code (NEC), and local amendments.
Written estimates are based on conditions observable at the time of assessment and remain valid for thirty (30) days. Estimates are not fixed-price contracts. Adjustments may result from concealed conditions, code compliance requirements, material cost changes, or scope modifications. Any adjustment exceeding ten percent (10%) of the original estimate requires your prior written consent.
Proposed timelines are good-faith estimates subject to adjustment for permit processing, material procurement, weather, subcontractor availability, and unforeseen site conditions. Living Space Solutions is not liable for delays arising from causes beyond its reasonable control. We will notify you promptly of any schedule changes.
Unless otherwise specified, a deposit of thirty to fifty percent (30-50%) is due upon execution of the service agreement. Progress payments are due upon completion of defined milestones. Final payment is due within fourteen (14) days of substantial completion and delivery of the final invoice. Overdue balances accrue interest at one and one-half percent (1.5%) per month. We accept checks, ACH transfers, and major credit cards.
Living Space Solutions warrants workmanship for a period of one (1) year from the date of substantial completion, unless extended in writing. This warranty covers defects in installation resulting from failure to meet workmanship standards. It excludes damage from misuse, improper maintenance, unauthorized modifications, acts of nature, or normal material degradation. Manufacturer warranties on materials, fixtures, and appliances are assigned to the homeowner upon installation.
To the fullest extent permitted by law, Living Space Solutions's aggregate liability for any claim arising from or related to services performed shall not exceed the total amount paid by you under the applicable service agreement. In no event shall Living Space Solutions be liable for indirect, incidental, consequential, punitive, or special damages.
All website content, design, logos, and proprietary methodologies are the intellectual property of Living Space Solutions and are protected under U.S. copyright and trademark law. Reproduction, distribution, or derivative use without written authorization is prohibited.
You are responsible for providing accurate project information, granting reasonable site access, securing HOA or architectural review board approvals, maintaining the property post-completion in a manner consistent with warranty requirements, and ensuring pre-existing code compliance where applicable.
These Terms are governed by the laws of the Commonwealth of USA, without regard to conflict-of-law principles. Exclusive jurisdiction for any legal proceeding rests with the state and federal courts in USA. You agree to first submit any dispute to mediation before initiating litigation.
